Two US police officers have been ordered to stand trial in the death of a mentally ill homeless man following a violent arrest last summer.
California's Orange County Superior Court Judge Walter Schwarm made the ruling after a hearing that included surveillance video of the confrontation between the officers and 37-year-old Kelly Thomas in the city of Fullerton.
Officer Manuel Ramos is charged with second-degree murder and involuntary manslaughter. Jay Cicinelli is charged with involuntary manslaughter and assault or battery by a public officer. Both have pleaded not guilty.
The officers confronted Thomas while responding to reports that a homeless man was looking into parked cars at a transit center.
"This is another victory, on another battle," said Thomas' father, Ron. "We're going to start a new one with the trial."
John Barnett, Ramos' attorney, said he would seek another court's review of Schwarm's ruling and did not expect his client would end up facing a jury trial.
"We're disappointed that they were held to answer but we will seek review in an appropriate manner," he told reporters after the ruling. "He believes, and he is innocent."
Orange County District Attorney Tony Rackauckas said during the hearing that Ramos bullied a shirtless Thomas with his menacing remarks and aggressive stance — actions that would have led anyone to fear they were about to get beaten by police.
"Any person, any creature on this earth would have fear at that point," Rackauckas told the court during the preliminary hearing.
"You're going to fight or flee because this is an imminent threat of a serious beating by a police officer who is there with a baton and a gun and other police officers.... This is going to be a very bad deal," the prosecutor said.
Defence attorneys countered that police — who are authorised and trained to use force when necessary — viewed the incident as an encounter with a man who refused to give his name and continued to resist arrest even as multiple officers rushed to assist.
The three-day hearing was marked by repeated showing of clips from surveillance video and audio recordings of the confrontation. The footage includes scenes of officers pummelling and pinning down Thomas as he screams that he can't breathe and moans for his father until he goes silent and is taken away by medics, leaving behind a pool of blood.
Barnett, Ramos' attorney, said during the hearing that the video — which was introduced by the prosecution — shows that his client made a conditional threat during his conversation with Thomas, stating he wanted the man to start listening and following police orders, such as sitting with his legs stretched out and providing his name to officers.
"All that Kelly Thomas had to do was simply comply," Barnett said. "Officer Ramos just lifts him up, he's going to arrest him. ... Not only can he do it, he must do it. He is bound to do it."
"Officer Ramos didn't do anything that should or could kill Kelly Thomas," Barnett said, pointing out that his client is often seen on the video at the man's feet.
Prosecutors have argued that Ramos punched Thomas in the ribs, tackled him and lay on him to hold him down while Cicinelli — who arrived later on the scene — used a Taser four times on Thomas as he hollered in pain and hit him in the face eight times with the Taser.
Thomas lost consciousness and was taken to a hospital. He was taken off life support and died five days later.
The coroner's office found that Thomas died from compression of his chest that made it difficult for him to breathe and deprived his brain of oxygen, and facial injuries stemming from his confrontation with law enforcement.
In court, Schwartz, Cicinelli's attorney, challenged those findings, noting that testimony by a paramedic who treated Thomas at the scene indicates that Thomas was breathing, although with difficulty, during the confrontation.
Schwartz also defended his client's use of the Taser on Thomas, who was still struggling and resisting officers' efforts to handcuff him, and said Cicinelli only swung the Taser at Thomas' hand when the man made an effort to grab the weapon.
"To call that a crime is to effectively handcuff our police officers out in the field from dealing with any combative suspect," Schwartz said.
The hearing in a Santa Ana courtroom was marked by lengthy testimony from medical experts and graphic photos of Thomas' injuries, including multiple bruises and a bloodied eye, while he was lying on the autopsy table.
Attorneys repeatedly played portions of the grainy surveillance video, which was paired with audio from digital recorders worn by some of the officers who were present and which brought some of Thomas' supporters to tears and prompted them to leave the courtroom.
The incident last July prompted an ongoing FBI investigation to determine if Thomas' civil rights were violated, an internal probe by the city, protests by residents and an effort to recall three Fullerton councilmembers that is slated for next month's ballot.
The recall was sparked after angry residents chastised the council members for failing to take significant action regarding the incident.

64 years ago, hundreds of thousands of Palestinians were forced out of their homes in the face of Jewish and later Israeli troop advances. They were displaced from Palestine and lost their land and property. It is still a painful memory for some who recall that day which is known as the catastrophe.
Hadeel Abokhaled’s grandmother was one of them.
She told they had forgotten their sister in the home where they were fleeing out of the home and they couldn’t come back and there are a lot of stories like the families who took the pillow instead of their babies so we hear a lot of stories like this.
She says, almost every Palestinian family living in refugee camps, has a similar story to tell.
Their towns and villages were razed to the ground to make way for Israeli colonies.
In the French capital, this demonstration is a show of strength, a show of support for hundreds of thousand of Palestinians who lost their land, homes and families in 1948.
Six decades on, Palestinian refugees are scattered in camps in the West bank and Gaza Strip, or in neighboring countries like Jordan, Syria, Lebanon or elsewhere.
Palestinians were forced out of their native land, but their love for their land has transcended boundaries and lived on 64 years after occupation passing down from generation to generation.
They are still holding fast to their Palestinian identity and right of return and not a single one of them has forgotten the key to the ancestral home.
Whatever the solution to the plight of the Palestinians, one thing is clear… the scars caused by pain, separation and humiliation will not disappear any time soon.

Commemorating the passing anniversary of late founder of the Islamic Republic of Iran Imam Khomeini;
The 24th passing anniversary of the late founder of the Islamic Republic Ayatollah Ruhollah Khomeini was an occasion for people to recall his accomplishments especially those of forming an Islamic state and working towards justice for mankind.
Addressing a large crowd of mourners, leader of Iran\\\\\\\'s Islamic Revolution Ayatollah Seyyed Ali Khamenei in a keynote speech said the Iranian nation would give a crushing response to the enemies with a high turnout in the upcoming presidential election.
He described the election as a manifestation of the will of the nation. The leader noted that people\\\\\\\'s participation in the election indicates their confidence in the Islamic establishment. According to Ayatollah Khamenei, the enemies are seeking to portray the election as a threat to the Islamic establishment whereas the vote is in fact a great opportunity.
Imam Khomeini changed the lives of Iranians and inspired people from other countries by guiding one of the greatest revolutionary movements of modern history to victory. His years of struggle against the tyranny of the US-backed Shah regime and capitalism served as a model for Muslim nations worldwide. Despite the passage of 24 years after his passing away, his thoughts and teachings still attract more people every day.
Ayatollah Khomeini passed away in June 1989, eleven days after he was taken to hospital for an operation to stop internal bleeding in May. He passed away but his legacy continues to live on forever.

Some recall and remember Ashura as an event where a movement came to an end. Imam Husayn (A) and his companions got martyred, his family got captured, and now we just mourn at the miseries and sufferings of Imam Husayn (A) and his family.
Others, take it to be the beginning of a new phase of the movement of Imam Husayn (A). This movement traveled through centuries and continued to flourish and get stronger over time. The climax of this movement is the reappearance of Imam Mahdi (A) who will fully accomplish the desired results of this movement.
Ask yourself, which group do you belong to...?

One of the important events that took place in the region at that time was the formation of a process of reconciliation through Arab-Israeli negotiations, which is referred to as the \"peace process\". This trend was shaped after Arab-Israeli negotiations. Recall that in 1993 an agreement was reached between Mr. Yasser Arafat and the Israelis, represented by Yitzhak Rabin and Shimon Peres; an agreement that was finalized under the auspices of the United States. This agreement was eventually named the \"Oslo Accords\". This was naturally a very dangerous issue and had a negative impact on the Arab-Israeli conflict. The danger was that, according to the agreement, the PLO recognized Israel and thus effectively a Palestinian group—not an Egyptian one like Anwar Sadat—abandoned the lands of 1948, the lands occupied by the Zionist regime during the 1948 Arab–Israeli War. Also, in that agreement it was mentioned that the topic of the negotiations would be East Jerusalem, the West Bank and the Gaza Strip and the issue of other parts of Palestine is already done. This was a major fault.
On the other hand, the agreement opened the way for many other Arab countries to begin negotiations and reach an agreement with Israel, eventually normalizing relations with Tel Aviv. This was a very dangerous issue. At that time, the Leader, and the Palestinian resistance groups including Hamas, the Islamic Jihad, and the Popular Front for the Liberation of Palestine opposed the Oslo Accords. The Commander in Chief and some Palestinian groups opposed the deal. So did Hezbollah and the Lebanese groups. We rallied against this agreement but were shot, and we had martyrs for the cause in Beirut\'s Southern Dahieh.
In any case, it was a turning point and a very dangerous period. We pondered over what reaction to adopt against the Oslo accord. Should we deal with it politically and through the media, and call on the Palestinians to resist and insist on their rights? The emergence of this issue (the Oslo Accords and the ensuing phase) led to the expansion and consolidation of relations between Hezbollah and Palestinian groups, including Hamas and the Islamic Jihad, and also strengthened the path of resistance in the occupied territories of Palestine. Remember that at that time, a major martyrdom-seeking operation was carried out by Hamas and Islamic Jihad militants in the heart of Tel Aviv and Quds, and shook the Zionist authorities to their core. It was after that operation, that an extraordinary meeting took place in the Egyptian city of Sharm El Sheikh with Clinton and Yeltsin, the then Russian president in attendance. Many countries in the world also attended this meeting. Meanwhile, the late Syrian president Hafez al-Assad rejected participating in the meeting.
The fact is that the meeting finally declared war on three groups: first Hezbollah, second Hamas, and the Islamic Jihad, and the third Islamic Republic of Iran due to its support for the resistance in the region. Despite its large sphere, the meeting did not manage to introduce fear in the ranks of Hezbollah and other resistance groups in the region, especially since at that time, the position of the Leader regarding the resistance—that is continuing the Resistance and persisting on the path— was absolutely straightforward and resolute. Therefore the Oslo accord brought about a series of events; events that were very crucial and hazardous for this procedure.

📌 Sayyed Nasrallah: Prophet Muhammad [PBUH] has a vital miracle that will remain until the day of resurrection, which is witnessed in all times; it is the holy book that Allah has sent him, the Holy Quran.
📌 Sayyed Nasrallah: The survival of this holy book in this accurate manner is a miracle in itself despite all reasons to distort it.
📌 Sayyed Nasrallah: The most notable achievement of Prophet Muhammad [PBUH] is the humanitarian achievement he made in the deep and huge transformation of the Arabian Peninsula community.
📌 Sayyed Nasrallah: All Muslims respect, sanctify, and appreciate this great prophet unlike any other human, though they love and appreciate all other prophets.
📌 Sayyed Nasrallah: Among the most important social points for Muslims is that they believe in the rank and the greatness of Prophet Muhammad [PBUH], and they view him as the most complete human and the closest creature to Allah the almighty.
📌 Sayyed Nasrallah: Muslims could never tolerate any insult or humiliation directed at the great prophet, and they consider defending the dignity of their prophet among the top priorities that is above all other interests and calculations.
📌 Sayyed Nasrallah: The Nice incident is strongly condemned and rejected by Islam, the religion that forbids killing or attacking civilians. All similar attacks are rejected in the first place from Islam\'s viewpoint.
📌 Sayyed Nasrallah: Neither the French authorities nor others are permitted to hold responsible the religion or the community of the religion to which the perpetrator belongs.
📌 Sayyed Nasrallah: If a Christian man commits such a crime, which happened indeed in France, is it right to say that all world\'s Christians are responsible for this crime?
📌 Sayyed Nasrallah: The US today commits crimes all over the world, and they admit the killing of thousands in such wars. Did any Muslim accuse Christians of those crimes just because the US President is Christian?
📌 Sayyed Nasrallah: Respecting Islam as a religion requires not using the terms of \"Islamic terrorism\" and \"Islamic fascism\"
📌 Sayyed Nasrallah: If some Muslims offended Islam it doesn\'t give the right to any other side to offend it too.
📌 Sayyed Nasrallah: The Takfiri terrorist ideology, which adopted killing just for ideological differences in our region, was protected by the West.
📌 Sayyed Nasrallah: The West has, in the first place, to look for its responsibility for Takfiri groups.
📌 Sayyed Nasrallah: The US administration and the European governments supported and funded Takfiri groups in Syria and Iraq.
📌 Sayyed Nasrallah: Prophet Muhammad [PBUH] and the Muslim nation have nothing to do with the crimes committed by the Takfiri groups.
📌 Sayyed Nasrallah: The Americans and the Europeans should reassess their behavior of using terrorists as tools in their political schemes and wars.
📌 Sayyed Nasrallah: Using such kind of tools must stop, otherwise you [the US and the West] will pay the prices for those mistakes.
📌 Sayyed Nasrallah: The crisis began when the French magazine published cartoons insulting Prophet Muhammad [PBUH], & the French authorities, instead of dealing with the issue, started a war of this kind & insisted to continue publishing such sarcastic cartoons.
📌 Sayyed Nasrallah: Instead of dealing with the repercussions, the French authorities should deal with the reasons. We have many evidences that they suppressed the freedom of expression in less sensitive issues that insulting the Prophet.
📌 Sayyed Nasrallah: Instead of dealing with the repercussions, the French authorities should deal with the reasons. We have many evidences that they suppressed the freedom of expression in less sensitive issues that insulting the Prophet.
📌 Sayyed Nasrallah: Freedom of expression in France and Europe is not absolute, it is rather restricted with security and political considerations. When it comes to \'Israel\', this freedom stops in France, and the examples are many. Why does it stop when it comes to anti-Semitism?
📌 Sayyed Nasrallah: We demand reassessing the concept of the freedom of expression, especially when it harms dignities. The French authorities should deal with this grave mistake.
📌 Sayyed Nasrallah addressing French authorities: Do not allow the progress of this aggression, violation and sarcasm. Offending the dignities of our Prophets is not accepted by any Muslim in the world.
📌 Sayyed Nasrallah: The Arab regimes that normalize with \'Israel\' can not remain silent and cover such offense against the sacred prophet for their people.
📌 Sayyed Nasrallah to the French authorities: You will lose this battle that you insist to continue. Where are France\'s interests in its relations with the Muslim world if it wants to continue in this situation?
📌 Sayyed Nasrallah: The responsibility for dealing with what happened in France is related to the French authorities\' performance.
📌 Sayyed Nasrallah hailed the strong significances of the Yemenis\' presence in defending the Prophet [PBUH] despite all difficulties: Despite the siege and war in Yemen, we find the Yemeni people assemble to celebrate the Prophet\'s birth anniversary.
📌 Sayyed Nasrallah: Muslims and the world should read yesterday\'s scene in Yemen with fidelity and religious background. And a major movement must be formed in the Arab world to press for ending this brutal war against Yemen. It is the least of our duties.
📌 Sayyed Nasrallah: The most significant thing Muslims would present today to Prophet Muhammad [PBUH] is to support the Yemeni people.
📌 Sayyed Nasrallah: We can not continue with a caretaker government. Hezbollah\'s information say that the cabinet formation circumstances are good and acceptable. We will cooperate and facilitate the formation. Time now is not for internal problems.
📌 Sayyed Nasrallah: I repeat and recall that leniency in the battle with the Coronavirus is unethical, inhumane and illegitimate. The responsibility for fighting the Coronavirus belongs to everybody; the government and people, not the Health Ministry alone.
